I know we all feel like celebrating the Supreme Court’s same-sex marriage ruling, folks, but we’re not out of the woods just yet.
Contrary to what a lot of news sites are saying (remember: mainstream legal reporting always gets the details hilariously wrong), this decision does not instantly strike down the remaining state-level same-sex marriage bans. It merely guarantees that those bans will be struck down if challenged in the appropriate courts.
Someone will still have to initiate a lawsuit in each of the remaining fourteen states. While the outcome of such a lawsuit is now certain, the procedure still needs to be followed, and a state that’s inclined to drag its heels could potentially draw the process out for months, even years, though various procedural shenanigans.
In other words, the contest to see which state is the most homophobic is still on.
